Aurea.gg — Terms of Service

Welcome to aurea.gg (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of the aurea.gg website, platform, and related services (the “Service”). By using the Service, you agree to be bound by these Terms and our Privacy Policy, and Cookie Policy (collectively, the “Agreement”). If you do not agree, do not use the Service.

1. Overview

aurea.gg is a social network and community for gamers that unifies gamer identity across platforms (e.g., Steam, Riot Games, Battle.net, PlayStation, Xbox, Epic, Discord, Twitch), automatically detects sessions, generates highlights and AI-assisted insights, and provides a verified social feed of gaming activities and discussions.

• Minimum age: You must be at least 13 (or the minimum age required by your local laws) to use the Service. In the EEA, the minimum age is 16 unless local law requires a higher age.
• If you are under 18, you must have permission from a parent or legal guardian.

2. Account Registration

To use certain features, you must create an aurea.gg account. When you register, you agree to:

• Provide accurate and up-to-date information.
• Maintain the security of your login credentials and not share them.
• Notify us immediately at support@aurea.gg of any unauthorized access or suspected compromise.
• Accept responsibility for all activity that occurs under your account.

We may refuse, suspend, or terminate accounts that violate the Agreement or present safety, security, legal, or operational risks.

3. Linking Third-Party Accounts

You may connect third-party services (e.g., Riot Games, Battle.net, Steam, Epic, PlayStation, Xbox, Discord, Twitch). By linking such accounts, you authorize aurea.gg to access and process permitted data (e.g., profile, identifiers, gameplay stats, match data) to provide features like verified activities, highlights, and insights, as described in our Privacy Policy. You can unlink accounts at any time in your settings.

Note: You are responsible for complying with those platforms’ terms and policies. We may throttle, modify, or disable integrations if required by third-party policies, stability, or security needs.

4. Acceptable Use

You agree to follow our Acceptable Use Policy. Without limitation, you will not:

• Use the Service for unlawful, harmful, or deceptive purposes.
• Post or share content that is abusive, hateful, harassing, obscene, sexually explicit involving minors, incites violence, or infringes others’ rights.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to hack, reverse engineer, bypass access controls, or disrupt the Service.
• Use automated scripts, bots, or scraping tools without our written permission.
• Interfere with or degrade the integrity, operation, or security of the Service or other users’ experiences.

We may moderate or remove content, rate-limit features, or suspend/terminate accounts to enforce these rules and protect users and the platform.

5. User Content and Licenses

You retain ownership of the content you post on aurea.gg (“User Content”). You grant aurea.gg a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, adapt, publish, display, perform, distribute, and otherwise use your User Content solely to operate, provide, improve, and promote the Service (including social discovery, leaderboards, highlights, challenges, and previews), in line with your privacy settings. This license ends when you delete the content from the Service, subject to reasonable caching and backups.

• Responsibility: You are responsible for the legality of your User Content and for obtaining any necessary rights.
• Removal: We may remove or restrict access to content that violates the Agreement or law, or poses safety/security risks.
• Feedback: If you provide ideas or suggestions, we may use them without restriction or attribution.

6. Highlights, Creator Tools & Beta Features

The Service may generate clips, summaries, overlays, and insights from your gaming sessions. You are responsible for ensuring your use complies with applicable game EULAs and content policies. Experimental/beta features may be modified, rate-limited, or discontinued and are provided “as is.”

7. Payments and Subscriptions

Some features may require payment (e.g., premium memberships, digital goods). Payments are processed by third-party providers (e.g., Stripe, PayPal). By purchasing, you agree to their terms and policies.

• Unless stated otherwise, all sales are final, subject to your statutory rights.
• Subscriptions may auto-renew unless canceled before renewal via your account settings.

8. Intellectual Property

Except for User Content, all content, software, designs, databases, and trademarks on the Service are owned by aurea.gg or its licensors and are protected by IP laws. No rights are granted except as expressly stated in these Terms. You may not copy, modify, translate, create derivative works, or distribute any part of the Service without our prior written consent.

9. Privacy; De-identified Analytics

Your use of the Service is subject to our Privacy Policy. We use de-identified and aggregated data to generate industry insights and may license/sell those aggregated outputs without using information that directly identifies you. See the Privacy Policy for your choices and opt-outs (including GPC and “Do Not Sell/Share” where applicable).

10. Suspension and Termination

We may suspend or terminate your access immediately (with or without notice) if you violate the Agreement, misuse the Service, or pose safety, security, or legal risks. You may delete your account at any time via settings or by contacting support@aurea.gg. Upon termination, your right to use the Service ends immediately, but provisions that by their nature should survive (e.g., IP ownership, disclaimers, limitations of liability, indemnification) will continue.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant uninterrupted or error-free operation, or that content will be preserved without loss.

12. Limitation of Liability

To the fullest extent permitted by law:

• aurea.gg and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses arising from or in connection with the Service or the Agreement.
• Our aggregate liability for any claim will not exceed the greater of €100 or the amounts you paid to aurea.gg (if any) in the 12 months preceding the claim.
• Some jurisdictions do not allow certain limitations; some provisions may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless aurea.gg, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to your User Content, your use of the Service, or your violation of the Agreement or applicable law.

14. Copyright/Trademark Complaints

If you believe content infringes your IP rights, please contact legal@aurea.gg with details (work asserted, location/links, your contact info, and a good-faith statement). We may remove content and take actions on repeat infringers consistent with applicable law.

15. Governing Law and Venue

If you reside in the EEA/UK, your mandatory consumer rights under local law remain unaffected. Otherwise, these Terms are governed by the laws of Spain, with exclusive venue in the courts of Barcelona, except where local law requires local courts. The U.N. Convention on the International Sale of Goods does not apply.

16. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will notify you by email and/or in-product notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

17. Miscellaneous

• Entire Agreement: These Terms, the Privacy Policy, Cookie Policy, and Acceptable Use Policy constitute the entire agreement between you and aurea.gg.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: Our failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale.
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
